Terms of Use

These terms govern the offering of, and all requests and enrollments in, any program or service offered by B-Systems Integration (collectively, the "Company," "we," and "our") and all other services provided by the Company (collectively, the "Services") to any person ("you"). These terms may be revised, updated, or replaced from time to time.

These Terms govern your use of the Polymorf software platform, applications, and other products and services. As some of our Services may be software downloaded to your computer, your phone, your tablet, or any other device, you agree that we will automatically update such software and that these Terms will apply to such updates. Please read these Terms carefully and contact us if you have any questions. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms (such as our Privacy Policy).

If you refuse to accept these Terms, you may not join any service or program.

You should print a copy of these Terms or save them on your computer for future reference. We modify these Terms from time to time. Each time you wish to join a program or service, please check these Terms to ensure that you understand the Terms that will apply at that time. These Terms, and any contract between us.

Disclaimers

The Services and all content included are provided "as is" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, the Company expressly disclaims:

  • All warranties arising from negotiation or use of commerce; and
  • Any liability related to your access or use of the Services or any related content.

You acknowledge and agree that any access or use of the Services or such content is at your own risk.

Prices and packages are subject to change without notice.

Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access, use, or inability to access or use the Services;
  • Any conduct or content of any party other than the Company, including without limitation, any defamatory, offensive, or illegal conduct; or
  • Unauthorized access, use, or modification of your content or information.

Data Protection

We will process your data only in accordance with these Terms and our Privacy Policy.

Payment and Registration

In the event you agree to purchase a package, the amount paid will not be exchangeable or refundable in whole or in part.

The package will be available for one year from the date of purchase.

In the event the package expires, the Free package will automatically be applied. The data displayed will be limited by the package. And you may at any time re-purchase a package after expiration.

Price and Tax Modifications

B-Systems may from time to time make changes to paid subscriptions, including recurring subscription fees, the prepaid period (for periods not yet paid), and will notify you of any price changes in advance. Price changes will take effect at the beginning of the subscription period following the date of the price change, and by continuing to use the Polymorf application after the price change takes effect, you will have accepted the new price. If you do not accept a price change, you may reject it by unsubscribing from the applicable paid subscription before the price change takes effect.


Renewal and Cancellation

Except for paid subscriptions for a prepaid period, your payment to B-Systems or the third party through which you purchased the paid subscription will automatically prompt you to renew it at the end of the applicable subscription period, unless you cancel your paid subscription before the end of the current subscription period. If the subscription is not renewed on time, you will be downgraded to the free version of the Polymorf application. We do not offer refunds or credits for remaining periods.

Right to Cancel and Delete Account

A user account may be cancelled and deleted. By deleting the account, all your data will be permanently deleted.

For any questions regarding your account and payment, please use the Customer Support resources integrated into the application. If you have any questions regarding the Polymorf application or these Terms (including any additional general terms of B-Systems incorporated herein), please contact B-Systems customer service by visiting the "About Us" section of our website. You may also contact us by postal mail.

Disclaimer of Warranty

THE POLYMORF APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

Limitation of Liability and Claim Filing Period

YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY PROBLEM OR DISSATISFACTION WITH THE POLYMORF APPLICATION IS TO UNINSTALL ANY B-SYSTEMS SOFTWARE AND TO STOP USING THE POLYMORF APPLICATION. YOU AGREE THAT B-SYSTEMS SHALL HAVE NO OBLIGATION OR LIABILITY ARISING FROM OR RELATED TO THIRD-PARTY APPLICATIONS OR THEIR CONTENT MADE AVAILABLE THROUGH OR IN CONNECTION WITH THE POLYMORF APPLICATION, AND ALTHOUGH YOUR RELATIONSHIP WITH SUCH THIRD-PARTY APPLICATIONS MAY BE GOVERNED BY SEPARATE AGREEMENTS WITH SUCH THIRD PARTIES, YOUR SOLE AND EXCLUSIVE REMEDY, WITH RESPECT TO B-SYSTEMS, FOR ANY PROBLEM OR DISSATISFACTION WITH THIRD-PARTY APPLICATIONS OR THEIR CONTENT, IS TO UNINSTALL OR STOP USING SUCH THIRD-PARTY APPLICATIONS.

Suspension and Termination of the Polymorf Application

These Terms will continue to apply to you until they are terminated by you or by B-Systems. B-Systems may terminate these Terms (including any additional terms incorporated herein) or suspend your access to the Polymorf application at any time if we believe you have breached any of these Terms, if we cease providing the Polymorf application or any hardware component thereof, or if we deem it necessary to comply with applicable law. If you or B-Systems terminate these Terms, or if B-Systems suspends your access to the Polymorf application, you agree that Polymorf shall have no liability to you, and (except as expressly provided in these Terms), B-Systems will not refund any amounts you have already paid. You may terminate these Terms at any time, in which case you may not continue to access or use the Polymorf application. Hacking and Reverse Engineering

You agree not to harm or damage the Polymorf application. In particular, you agree not to overload, disrupt, hack, modify, or reverse engineer the web core or any associated software. Furthermore, you agree not to interfere with the use of the Polymorf application by other users.
